GENERAL
1.1. The following Terms and Conditions apply to all orders placed by the customer (hereinafter referred to as “you”) on www.domusartgalleryathens.com (hereinafter referred to as “we” or as “Website”).
1.2. We reserve the right to amend these Terms and Conditions without prior notice to you. The version of the Terms and Conditions applying to your order is the one you agree upon at the time you place your order.

ORDERING
2.1. Only persons of legal age can place an order.
2.2. Each submitted order constitutes an offer to purchase goods for sale on the Website. Orders are subject to our acceptance, and we reserve the right to refuse sale to whomever we please without giving any reasons.
2.3. Order confirmation is merely information that your order has been received. Purchase contract only starts when the ordered goods are dispatched to you and is only valid once payment has been received in full.
2.4. If for any reason we are unable to fulfill your order, you will be informed as soon as practicable and if payment for such order has been received, payment will be refunded to you using the payment method you used for your initial purchase. Bank fees, credit card processor fees and any other similar fees out of our control won’t be refunded.

PRICES AND SHIPPING
3.1. Prices for goods (and eventual special offers) displayed on the Website are valid at the time they occur. Prices for any same goods (and eventual special offers) displayed in other stores, catalogues or on other websites and on the Website may differ from each other at any given time.
3.2. We strive to ensure that all pricing details displayed on the Website are correct, and we cannot be held responsible for any printing or spelling errors in pricing display.
3.3. Prices displayed on each product’s page on the Website are exc. Greek VAT (Value Added Tax or VAT, 24%). If applicable, 24% VAT will be added at checkout according to your billing address.
3.4. Shipping services available on the Website at any given time are provided on an ‘as is’ and ‘as available’ basis.

PAYMENT METHODS
Goods for sale on the Website can only be paid for using the payment gateways available on the Website at the moment of purchase. Payment gateways and payment providers available on the Website at any given time are provided on an ‘as is’ and ‘as available’ basis.

DELIVERY ORDERS
We strive to keep delivery times as short as practicable. Since most goods sold on the Website are custom produced paintings, numbered and signed by hand, however, if you need your artwork to be delivered by a specific firm date please contact us before ordering to make sure that your artwork will be delivered by your required deadline.

CANCELLING ORDERS
If you change your mind or are not completely satisfied with any goods purchased on the Website, you may cancel your order without giving any reason starting from the date your order has been placed up to 14 days from the day on which you acquire (or a third party other than the carrier and indicated by you acquires) physical possession of the goods, by sending us an unequivocal statement (e.g. a letter sent by registered mail or certified email) of your decision to withdraw from your purchase and consequently returning the goods. We will refund any such goods within a maximum of 14 days after receipt of the returned goods, provided that they have been returned in like-new conditions. WARRANTY
Goods sold on the website are covered by a 2-year warranty period starting from the purchase date stated on your receipt. For warranty claims to be processed you should be able to present such receipt and return the defective goods to us. Return costs are in your sole and full responsibility. The warranty does not cover damages caused by, i.e. only and without limitation to, malicious actions, improper use or misuse, chemical and/or radioactive contamination, government interventions, wars, civil unrests, hijacking, fires, floods, accidents, storms and/or tornados, epidemics and pandemics, strikes, lockouts and terrorist attacks. Claiming warranty during the warranty period means that the defective goods are replaced with identical goods. If the goods in question is a single copy artwork, the new copy will bear the same number and exact same characteristics and replacement will not affect the uniqueness of your artwork for collection purpose.

DAMAGE IN TRANSIT
In the event of damage occurred to the parcel in transit please report any visible damage directly to the carrier which has delivered the parcel to you.

LIABILITY LIMITATION
9.1. We do not accept any liability for any damage to your computer system or for any loss of data that may result to you from your use of the Website.
9.2. We do not guarantee which contents, goods and services will be available on the Website at any given time. All contents, goods and services available on the Website at any given time are provided on an ‘as is’ and ‘as available’ basis.
9.3. We do not guarantee that the Website will be working continuously and perfectly, and we do not accept any liability for any damage that may result to you from interruption of service.
9.4. We do not guarantee that the information on the Website will be free from errors or omissions and while we do not accept any liability for any damage that may result to you from eventual such errors and omissions, we will strive to correct any eventual such errors or omissions as soon as practicable once we are made aware of them.
9.5. We do not accept any liability or any part in any controversies that shall arise between you and the payment providers used by the Website at any given time.

FORCE MAJEURE
We are not responsible for any delay or failure to comply with any our obligation under these Terms and Conditions if the delay or failure arises out of events beyond our reasonable control. Such events shall include, i.e. only and without limitation to, failures of infrastructures either physical or informatics, government interventions, wars, civil unrests, hijacking, fires, floods, accidents, storms and/or tornados, epidemics and pandemics, strikes, lockouts, cancelled flights or trains, terrorist attacks or industrial action affecting either us, our suppliers or our chosen delivery services.
